Purchase Terms & Conditions

1) All returns must be in its original condition and packaging and are subject to warehouse inspection and approval. All approved returns are subject to a 35% restocking and handling charge. An additional 3.5% fee will be applied to any returned or cancelled orders paid via credit card.

2) If for some reason material is wrong or defective, the buyer shall notify Gramar Stone Center, Inc. in writing within 5 days after receipt of material.

3) All materials are sold in as-is condition and there are no warranties unless provided in writing by the manufacturer. We extend no guarantees, expressed or implied, as to slipperiness, wear resistance or maintenance procedures.

4) Gramar Stone Center, Inc. will only accept full order returns made within fourteen (14) days of the purchase date for stock items. Partial returns will not be accepted on any orders.

5) Contractor/Homeowner is responsible for inspecting the materials prior to installation. Absolutely no returns or exchanges for special orders, non-stock items, partial orders, and/or installed materials. INSTALLATION IS ACCEPTANCE.

6) All orders must be picked up in 30 days, orders not picked up in 30 days will be returned to stock and no refund will be issued to the customer.

7) Absolutely no returns, cancellations, or exchanges for special orders, non-stock, partial orders, and fabricated or installed materials.

8) Natural Stone is a product of nature and therefore is subject to variation of colors, shading, veins, markings, and texture, thickness, etc. The typical variation of a stone is dependent upon the type of stone selected. Showroom samples are for representative purposes; current stock or batch might be different than the showroom sample. All natural stone is subject to some wearing and/or scratching over time. Food and/or other acids may stain or etch the surface of some stones.

9) Gramar Stone Center, Inc. is not responsible for materials once it leaves our premises. All materials must be inspected by the purchaser or agent, assign, employee of purchases upon receipt of merchandise.

10) Original receipt required for any claims, exchanges, returns and refunds.

11) Purchaser, Purchaser’s authorized agent, and/or signatory to this Agreement agrees to have seen, read, and understood relevant Prop 65 information for associated product(s).

12) Purchaser, Purchaser’s authorized agent, and/or signatory to this Agreement agrees to release Gramar Stone Center, Inc. from all liabilities, losses, claims, judgments, suits, fines, penalties, demands, or expenses that may result from the purchase, sale, order, transportation, cutting, manipulation, or preparation of such stone products, including claims of negligence, defective product, breach of warranty, failure to warn and/or negligent misrepresentation.

13) Purchaser, Purchaser’s authorized agent, and/or signatory to this Agreement agrees to warn any contractors, subcontractors, employees, assigns, or agents in the sale, transfer, transportation, cutting, manipulation, or preparation of such stone products, and that the products may contain crystalline silica and/or asbestos which may be released upon the cutting or manipulation of such stone products.

14) Purchaser, Purchaser’s authorized agent, and/or signatory to this Agreement agrees these Terms & Conditions are reasonable, valid, and enforceable. If any term, covenant, condition, or provision is held by a court of competent jurisdiction to be invalid, void, or unenforceable, Gramar Stone Center, Inc. and Purchaser agree that such provision be changed in scope by the court only to the extent deemed necessary by that court to render the provision reasonable and enforceable, and the remainder of the provisions will in no way be affected, impaired, or invalidated as a result. The validity, construction and performance of these Terms & Conditions shall be governed and construed in accordance with the laws of California, without giving effect to any form of conflict of law provisions thereof.

15) Gramar Stone Center, Inc. is not responsible for materials once it leaves our premises.

16) Delinquent accounts and accounts past due shall be charged an interest rate of 1.5% per month (18% per annum) or the highest rate allowed by California Law. If legal action is required to enforce the terms of this sale, seller shall be entitled to recover costs and reasonable attorney’s fees incidental to any collection activity undertaken, whether a lawsuit is instituted or not. $30.00 fee will be applied to any return checks.

17) All slabs are provided with a safety label indicating the risks identified.

Términos y Condiciones

1) Todas las devoluciones deben estar en su condición original y empaque y están sujetas a inspección y aprobación del almacén. Todas las devoluciones aprobadas están sujetas a un cargo de reposición y manejo del 35%. Se aplicará una tarifa adicional del 3% a cualquier pedido devuelto o cancelado pagado mediante tarjeta de crédito.

2) Si por alguna razón el material es incorrecto o defectuoso, el comprador deberá notificar a Gramar Stone Center, Inc. por escrito dentro de los 5 días posteriores a la recepción del material.

3) Todos los materiales se venden en condición tal cual y no hay garantías a menos que se proporcionen por escrito por el fabricante. Nosotros no extendemos garantías, expresadas o implícitas, en cuanto a resbalosidad, resistencia al desgaste o procedimientos de mantenimiento.

4) Gramar Stone Center, Inc. sólo aceptará devoluciones del pedido completo realizadas dentro de los catorce (14) días siguientes a la fecha de compra para artículos en stock. No se aceptarán devoluciones parciales en ningún pedido.

5) El contratista/propietario es responsable de inspeccionar los materiales antes de la instalación. Absolutamente no se aceptan devoluciones o cambios para pedidos especiales, artículos que no son de stock, pedidos parciales y/o materiales instalados. LA INSTALACIÓN ES ACEPTACIÓN.

6) Todos los pedidos deben ser recogidos en 30 días, los pedidos que no se recojan en 30 días serán devueltos al stock y no se emitirá reembolso al cliente.

7) Absolutamente no se aceptan devoluciones, cancelaciones o cambios para pedidos especiales, artículos que no son de stock, pedidos parciales, y materiales fabricados o instalados.

8) La Piedra Natural es un producto de la naturaleza y por lo tanto está sujeta a variaciones de colores, sombras, vetas, marcas y textura, grosor, etc. La variación típica de una piedra depende del tipo de piedra seleccionada. Las muestras en el showroom son con fines representativos; el stock actual o lote puede ser diferente a la muestra del showroom. Toda piedra natural está sujeta a cierto desgaste y/o rayado con el tiempo. Los alimentos y/u otros ácidos pueden manchar o grabar la superficie de algunas piedras.

9) Gramar Stone Center, Inc. no es responsable de los materiales una vez que salen de nuestras instalaciones. Todos los materiales deben ser inspeccionados por el comprador o agente, asignado, empleado del comprador al recibir la mercancía.

10) Se requiere el recibo original para cualquier reclamo, cambio, devolución y reembolsos.

11) El comprador, el agente autorizado del comprador y/o el firmante de este Acuerdo acepta haber visto, leído y entendido la información relevante de la Prop 65 para el(los) producto(s) asociado(s).

12) El comprador, el agente autorizado del comprador y/o el firmante de este Acuerdo acepta liberar a Gramar Stone Center, Inc. de todas las responsabilidades, pérdidas, reclamos, juicios, demandas, multas, sanciones, demandas o gastos que puedan resultar de la compra, venta, pedido, transporte, corte, manipulación o preparación de dichos productos de piedra, incluyendo reclamos por negligencia, producto defectuoso, incumplimiento de la garantía, falta de advertencia y/o representación negligente.

13) El comprador, el agente autorizado del comprador y/o el firmante de este Acuerdo acepta advertir a los contratistas, subcontratistas, empleados, asignados o agentes en la venta, transferencia, transporte, corte, manipulación o preparación de dichos productos de piedra, y que los productos pueden contener sílice cristalina y/o asbesto que pueden liberarse al cortar o manipular dichos productos de piedra.

14) El comprador, el agente autorizado del comprador y/o el firmante de este Acuerdo acepta que estos Términos y Condiciones son razonables, válidos y ejecutables. Si algún término, pacto, condición o disposición es considerado por un tribunal de jurisdicción competente como inválido, nulo o inaplicable, Gramar Stone Center, Inc. y el comprador acuerdan que dicho tribunal solo cambie el alcance de la disposición en la medida que se considere necesario por el tribunal para hacer la disposición razonable y ejecutable, y el resto de las disposiciones de ninguna manera serán afectadas, perjudicadas o invalidadas como resultado. La validez, construcción y desempeño de estos Términos y Condiciones se regirán e interpretarán de acuerdo con las leyes de California, sin dar efecto a ningún tipo de disposiciones de conflicto de leyes.

15) Gramar Stone Center, Inc. no es responsable de los materiales una vez que salen de nuestras instalaciones.

16) Todas las losas van provistas de una etiqueta de seguridad que indica los riesgos identificados.
